A man who was sentenced for failing to provide after being suspected of drug driving has had his appeal dismissed.
Bradley Warren, 32, of Haig Close, Swindon, was charged with two counts of failing to provide after refusing to provide a blood sample for analysis following two separate arrests for drug driving in Swindon in October and November 2023.
Warren pleaded not guilty, claiming a phobia of needles, but was found guilty of the offences in a hearing at Swindon Magistrates’ Court on June 28.
He appealed the conviction, however on February 13 at a hearing at Swindon Crown Court this was dismissed on the basis that the phobia was not medically diagnosed.
The original sentence of a 16-month disqualification from driving was upheld and Warren was instructed to pay costs of £1,300.
Roads Policing officer Craig Beales said: “Warren was arrested twice within the span of six weeks on suspicion of drug driving and refused to provide a blood sample for analysis.
“I’m pleased the court has dismissed his appeal and that Warren is now banned from the roads.
“Drug driving is one of the fatal five offences and we will always look to pursue dangerous offenders who put themselves and other road users at risk by getting behind the wheel while under the influence.”
